In the municipality of Breda, there are new rules for the rental of investment properties. Purchase protection has been in place since May. For four years after registration, it is prohibited to rent out protected living space without a rental permit, purchase protection from the mayor and aldermen. These rules apply to homes with a WOZ value that does not exceed the National Mortgage Guarantee (NHG) limit and that have not been rented out before (or for a period of less than 6 months).
The municipality of Breda is taking these measures to address the scarcity of affordable homes for sale. The aim is to prevent commercial landlords from raising prices, disadvantaging people with lower or middle incomes, especially first-time buyers. Currently, people with lower and middle incomes are experiencing difficulties in the housing market.
The municipality has designated protected living space, including all homes in the municipality of Breda with a WOZ value that does not exceed the NHG limit (405,000 euros in 2023). In addition, homes that have not been rented out before or have been rented for a period of less than 6 months fall under these rules. Homes that are rented out with a rental permit and purchase protection also fall under this.
Certain buildings are subject to a permit. These are buildings owned by private landlords, institutional investors and authorized institutions (with the exception of Breda housing associations). These buildings include residential areas intended for rental, rented living spaces or former rented living spaces with a maximum area of 200 m2. Buildings whose rental price or former rent of a separate part of the living space is lower than the amount set for the rent allowance limit also fall under the licensing requirement.
As the owner of a rented living space, you can apply for a rental permit, purchase protection, to the college. To do this, you can find the form on the website www.breda.nl. The municipality of Breda grants the rental permit purchase protection if the living space is rented out to a home seeker who is a first or second degree relative of the owner, if you have used the home as your own home address for at least 12 months and want to rent it out for a maximum of 12 months (no tourist rental), or if the living space is an integral part of a retail, office or business space.
It is important to comply with the rules, because in case of violation of the rental license, purchase protection, fines are imposed by the municipality. The first offence costs 4,000 euros and can amount to 12,000 euros per offence.
